Consumer Privacy. If you are a California resident, the California Consumer Privacy Act (“CCPA”) supplements the information contained in our Privacy Policy and may provide you with additional rights related to your Personal Information as described below.

Categories of Personal Information Collected We collect information that identifies relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or Device. The following is a list of categories of personal information which we may collect or may have been collected from California residents within the last twelve (12) months. Please note that the categories and examples provided in the list below are those defined in the CCPA. This does not mean that all examples of that category of personal information were in fact collected by Us, but reflects our good faith belief to the best of our knowledge that some of that information from the applicable category may be and may have been collected. For example, certain categories of personal information would only be collected if You provided such personal information directly to Us.

Examples: A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, driver’s license number, passport number, or other similar identifiers.

Category B: Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).

Examples: A name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Some personal information included in this category may overlap with other categories. 

Collected: Yes

Category C: Protected classification characteristics under California or federal law.

Examples: Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information). 

Collected: No. 

Category D: Commercial information.

Examples: Records and history of products or services purchased or considered. 

Collected: Yes.

Category E: Biometric information.

Examples: Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data. 

Collected: No. 

Category F: Internet or other similar network activity.

Examples: Interaction with our Service or advertisement. 

Collected: Yes. 

Category G: Geolocation data.

Examples: Approximate physical location

Generalized geolocation data extrapolated from IP Addresses. 

Collected: yes.

Category H: Sensory data.

Examples: Audio, electronic, visual, thermal, olfactory, or similar information. 

Collected: No.

Category I: Professional or employment-related information.

Examples: Current or past job history or performance evaluations. 

Collected: No.

Category J: Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)).

Examples: Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records. 

Collected: No.

Category K: Inferences drawn from other personal information.

Examples: Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. 

Collected: No.

Under CCPA, personal information does not include:

  • Publicly available information from government records.
  • De-identified or aggregated consumer information.
  • Information excluded from the scope of the CCPA, like:
    • health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; and
    • personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

We obtain the categories of Personal Information listed above from the following categories:

  • Directly from our clients or their agents. For example, from documents that our clients provide to us related to the services, for which they engage us.
  • Indirectly from our clients or their agents. For example, through information we collect from our clients in the course of providing services to them.
  • Directly or indirectly from activity on Our Site. For example, from submissions through Our Site portal or from usage details collected automatically on Our Site.

How We Use Information We Collect.

We use the information we collect from users of our Service in order to provide you with more meaningful content and advertising content and to offer you relevant products and services, as well as to maintain, protect and improve your overall experience. In particular, you may choose (i) to subscribe to any of our electronic newsletters, (ii) to receive “special offers” by SD and its various service providers, (iii) to receive business opportunity or tips or information from selected advertisers, and we will use your information for these purposes provided you have given us your consent. You may also choose (iv) to submit questions or comments in response to content on our Service, or (v) to purchase products and related offers on our affiliated website’s in which case, we will process your information to perform our agreement or comply with your request. 

In each of those instances, you will be asked to provide, and we will collect and store, certain personal information such as email address, zip code, telephone number, and in some instances information about your business.

You can remove yourself from any such electronic newsletters and otherwise stop receiving any further promotions and other commercial communications by following the “unsubscribe” directions included with each newsletter or, in all of the above instances, by sending an email with the word “unsubscribe” in the subject line to info@startupsdictionary.com. 

We use information collected from cookies and other technologies, like pixel tags, to improve your user experience and the overall quality of our services. You can reset your browser to reject all cookies or to indicate when a cookie is being sent. But you need to know that you may not be able to access or use some features and services on our Service without cookies. A pixel tag is a type of technology which is placed on a website or within an email and used for the purpose of tracking activity on a website and is often used in combination with cookies. We do not track our users across third party websites and thus do not respond to Do Not Track (“DNT”) signals. However, some third party websites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, certain website browsers allow you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.

How We Share Personal Information.

Use of Personal Information for Business Purposes or Commercial Purposes We may use or disclose personal information We collect for “business purposes” or “commercial purposes” (as defined under the CCPA), which may include the following examples: 

  • To operate our Service and provide You with our Service. 
  • To provide You with support and to respond to Your inquiries, including to investigate and address Your concerns and monitor and improve our Service.
  • To fulfill or meet the reason You provided the information. For example, if You share Your contact information to ask a question about our Service, We will use that personal information to respond to Your inquiry. If You provide Your personal information to purchase a product or service, We will use that information to process Your payment and facilitate delivery. 
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations. 
  • As described to You when collecting Your personal information or as otherwise set forth in the CCPA. 
  • For internal administrative and auditing purposes. 
  • To detect security incidents and protect against malicious, deceptive, fraudulent or illegal activity, including, when necessary, to prosecute those responsible for such activities.

Your Rights and Choices about What Personal Information We Collect and Maintain and How We Use It.

The CCPA provides consumers (California residents) with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to You about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of Personal Information we collected about you.
  • The categories of sources for the Personal Information we collected about you.
  • Our business or commercial purpose (as defined in Section 6 below) for collecting or selling (as also defined in Section 6 below) that Personal Information.
  • The categories of third parties, with whom we share that Personal Information.
  • The specific pieces of Personal Information we collected about YOU (also called a data portability request).
  • If we sold or disclosed YOUR Personal Information for a business purpose, two separate lists disclosing:
    • sales, identifying the Personal Information categories that each category of recipient purchased; and
    • disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

Deletion Request Rights:

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

We may deny your deletion request if retaining the Personal Information you request to have deleted is necessary for us or our service providers to:

  1. Complete the transaction, for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products in order to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise his/her free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. If you had previously provided informed consent, engage in public or peer-reviewed scientific, historical, or statistical research in the public interest, that adheres to all other applicable ethics and privacy laws, when deletion of the Personal Information may likely render impossible or seriously impair the purpose(s) of that research.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with any legal obligation(s) we may have.
  9. Make other internal and lawful use of that Personal Information that is compatible with the context in which you provided that Information.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only You or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the Personal Information relates to you.  Making a verifiable consumer request does not require you to create an account with us.  We will only use Personal Information provided in a verifiable consumer request to verify your identity as the person making the request or having your authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt.  If we require more time (up to 90 days), we will inform you in writing of the reason(s) why we will need more time and the additional time needed.  If you have an account with us, we will deliver our written response to that account.  If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.  Any disclosures we provide will only cover the 12-month period preceding our receipt of your verifiable consumer request.  The response we provide will also explain any reason(s) why we cannot comply with your request (if applicable).  For data portability requests, we will select a format for providing your Personal Information which is readily usable and which should allow you to transmit that Information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination.

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you with a different level or quality of goods or services.
  • Suggests that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Privacy Policy Revisions and Updates.

Our Privacy Policy may be revised from time to time, in which case the Privacy Policy you view will be the most current version and the date of the latest such revision will be identified at the beginning of this Privacy Policy.
